Is my insurance company wrong to not waive my deductible if the accident is not my fault?
|

I recently was in a car accident, and was rear ended on the freeway. We both had insurance, and the driver of the truck that hit me was found to be 100% at fault. Upon contacting MY insurance company, they insisted I would have to pay my deductible ($500) if I wanted to go through my insurance have them handle the other person's insurance company. There is damage, the need for a rental, and injuries I am trying to handle. What is the best way to handle a situation like this? Can my insurance company make me pay my deductible when I was not a fault? Or is it just easier to dealer with the other driver's insurance directly since there is no dispute of fault? It was just a minor accident, so I don't really think an attorney would be beneficial, or would it? HELP!
