In November 2012, I engaged Higbee & Associates to perform expungement and database updating services in order to seek employment. After a minimal effort, Higbee & Associates discovered that my case had been dismissed over 20 years ago. Apparently, the
courts did not inform me of this fact, nor were the State Department of Justice (DOJ) records updated. I requested Higbee & Associates to instruct me how to correct the DOJ record. I followed Higbee & Associates’ advice, but the DOJ rejected my request. Higbee
& Associates told me that I could pay them an additional $600 to appeal this decision. I decided to ask the DOJ what to do instead. It appears that Higbee & Associates had provided me with the right form, but the wrong document to accomplish the task. After
the DOJ identified the correct document, I went to the County Court record’s office; obtained the appropriate document; submitted it, and my record was corrected. In the last 16 months, Higbee & Associates obtained a total of two court records, and provided
faulty information on how to correct the DOJ record. They also provided database updating services, though this was done prior to the DOJ records being corrected, which made the update virtually useless.

The fact that the court did not inform you (or that you forgot) that your conviction was expunged prior to you hiring us was not our fault. Nor was it our fault that the court did not update the records at the California Department of Justice. As a result of those two things, we had to do twice the amount of work. While most attorneys would have charged you extra for the complications of your case. We did not. As far as updating the private sector background check database update (which we gave you for free), you received the full benefit of it. The private databases are not affected by updating (or lack of updating) of the CA Dept. of Justice records. In conclusion, we reduced a bill that should have been more than $2,000 in attorneys fees + $270 in costs to $879. We waived more than $1400 of what was owed under the contract.
