I was first contacted via a direct mailed campaign by Financial Litigation Law Group (FLLG) offering Loan Modification on my mortgage. I called to inquire about their Loan Modification program. Verbally the process was spelled out that they look at our mortgage papers to look for inconsistencies and perhaps some fraudulent processes to use as leverage With the mortgage company, and this whole program was tied to the ARRA stimulus package, and would take only 60 -90 days to complete. They verbally stated that With what we paid for mortgage that there was a very high probability that we could reduce our payments substantially maybe as high as "$800.00" they said. I asked if they were guaranteeing this, they of course said no, but With what we paid and the stimulus package it shouldn't be a problem. Then they sent me a contract to do a review of my mortgage documents at a cost of $3,500.00. They called and wanted to know when I was going to send the contract in and said if I didn't hurry the laws in California were changing and I might miss out. I said this does not say anything about a Loan Modification, again I was told this was the first step in the Loan Modification process, so I signed.

That's where they got me....I signed a contract essentially for a "forensic" document review. Even though it took them nearly a year to complete, and it cost me another $75.00 for copies and FedEx only to find out that they exposed me to foreclosure. Then when I ask for a refund for failure to get a loan modification of any amount, the FLLP owner Keyvan Samini replies to my requests for a refund for their not living up to the verbal commitments made by Will Henry, Claudio Weinstein (who are no longer With the company) and Ofelia Aguilar (who was helpful)says hey he signed a contract for a forensic review of his mortgage documents, we never said anything about Loan Modification. Not only did they not live up to the timelines of the "forensic" review 60 - 90 days, he turns it back on me saying I knew what I signed.

Here is just one email excerpt on my journey With FLLP:

Ofelia,

We received a package from FLLG on or around the 19th of August. This package contained a letter that FLLG after completing the forensic loan audit, the finding were that the loan is compliant. We then received documents from National Asset Protection Corporation to send into our lender GMAC, indicating that FLLG was no longer involved. This is simply unacceptable.

The August 19, 2010 letter from FLLG indicated that we retained the FLLG for a forensic loan audit on March 1, 2010. With a contingency of a loan restructure. Our contract With FLLG was dated Oct 30th of 2009 (see the attached copy of all executed documents).

We only began this loan modification process With the understanding that this contract ;
I made a phone call inquiry into the FLLG loan modification program and costs.
We were then solicited by FLLG and after initial discussions With FLLP personnel that under the new administration and the subsequent ARRA programs we qualified for a loan modification for a reduction of our monthly payments via based on a phone interview;
lower interest
longer term
or partial debit forgiveness
This contract was for a loan modification not a forensic loan audit
We then were continually contacted by the FLLG and further given verbal guarantees by Will Henry and Claudio Weinstien that based on our financial position in Oct 2009 that we would have a reduction on our mortgage.
Our only cost would be the initial $3,500.00
That this loan modification would only take 60-90 working days
This contract With FLLP under any circumstances would not expose us to or initiate a foreclosure
If FLLG could not get a loan modification, and get some reduction of as little as $50.00 per month (Will Henry explained that FLLG had undergone a law suit as the expected return wasn't what the person thought it should be) and now the expectations were to be something, but FLLG could not state what we could expect until they received our agreement and fees for service of $3,500.00, although Will Henry threw out that $800 per month based on our mortgage was not out of the question, and if FLLG could not negotiate a loan modification then we receive our $3,500.00 fee back.
Unfortunately FLLG could not fulfill any of these obligations.
On October 8, 2009 I emailed the Authorization forms to Claudio. Based on requests from Rachel Stewart we first faxed forms to FLLG on March 29th , which was 5 months, over 100 working days to begin the loan modification process.
Once the process began, it wasn't until August 19th (another 90 working days) that we received noticed signed by Jason Bois that we were now on our own to contact the mortgage company to continue the restructuring review process, and that by doing so the lender may choose to foreclose, which we specifically stated we wanted to avoid.
During this time we spent well over $75.00 in additional mailing costs, not to mention the hours to fill out and gather all additional paperwork for the process.
So it is this email that I ask to begin the process of requesting amiably that FLLG refund our $3,500.00 fee for the loan modification on the following basis;
FLLG did not live up to their postal advertisements, and verbal commitments for savings, and provide a loan modification as they stated they could without exposing us to foreclosure.
FLLG took nearly 10 months to complete their responsibilities in their view for the contract we agreed to for a loan modification, and during that time our financial state had changed to the detriment, which had they completed their work in the 60 -90 days as advertised and verbally committed to by Will Henry our point of contact and an employee of FLLG at the time of our Authorization instead of 190 working days, we may have been able to receive a loan modification that would have been beneficial to us now.
The solution they found was to turn us over to another firm National Asset Protection (same address as FLLG), I suspect a subsidiary, or an affiliation of FLLG to work out some sort of monthly payment that required our filing papers monthly and exposed us to foreclosure. Again unacceptable.

Its the old adage...If it sounds to good to be true, it probably is.

I always was told that attorney's needed to speak With truth and represent the truth. I guess Mr. Samini missed that class.
