Issues Wrong Reports; Won't make good on them

Buyer of my 1,050 sq ft frame house wanted home inspection. At realtor's suggestion I used Home Buyers Safeguard (HBS). Inspection report of 7/9/12 listed small problems (rust on swamp cooler, leaky faucets) but said "Kitchen floor buckling; Recommend consult with Structural Engineer to determine if floor resting on soil." It could not have been true because house sits on a crawlspace, but HBS refused to discuss the report until follow-up inspection. On 7/11/2012 buyer reopened negotiations and lowered his offer by $6,000 because of the HBS report (he thought I had lied about house's condition). Inspector approved the repairs I made and issued home warranty, then said that the "floor is buckling, consult Structural Engineer" comment had come from a report on a DIFFERENT HOUSE and he had mixed them up. He promised to fix report. Had to request new report 3 times before I got it, but buyer would not return to original purchase price. House had been on market for 10 months so I had to agree to a $1,000 drop to keep from losing the sale. I filed BBB complaint, asking for $1K plus the price of the inspection as compensation. HBS refused compensation, but finally apologized. HBS incompetence cost me $1,000, and the inspection report was essentially useless. If you use this firm, double check its work. Had original report been correct my buyer would not have been able to re-open negotiations. HBS would have saved me $1,000 by correcting the flawed report right away, but it refused to.

It is most unfortunate that a "Full Home Report" that contained incorrect information was issued. This was the result of a clerical error made by the inspector. I have apologized for the mistake. However, the mistake became evident and was corrected prior to the closing on this property.If the buyer reduced his offer by $6000, why then did he settle for only a $1000 price reduction? At this point, the buyer was aware that a mistake had been made regarding the floor and in fact, the flooring was no longer a consideration. Other issues still remained that were noted in the inspection reports. Our information indicates that this was the reason the buyer agreed to a $1000 reduction rather than a $6000 price reduction. We have asked the seller to provide us with indisputable proof that the buyer demanded and received a $1000 price reduction based solely on the erroneous information regarding the floor. To date, we have not received any such proof. Again, we apologize for the error.
