Janian and Associates cost me my home !!!
In the first week of April, 2010 we contacted Janian and Associates in hopes to refinance our mortgage. My wife was on disability, and basically ¾ of my check went to medical insurance, so we were struggling to make our payments and were told that the Obama plan could help us save our home by lowering the monthly mortgage payments. We placed a couple of phone calls to lawyers offices that deal specifically with the Obama plan and real estate. A representative from Janian and Associates was the first to contact us. In that first discussion, it was explained to us how they can help via the Obama plan, how the process will only take 90 to 180 days and most specifically if things do not pan out the way they should and the process fails we can expect an full refund within 30 days upon request. In questioning problems such as being unable to afford the quarterly taxes, mortgage payments and house insurance, we were told that not making payment on those subjects would not be an issue and even assist by proving the hardship case they were trying to build. On April 14th, 2010 paperwork was faxed to us by that representative, Jennifer Dixon to complete and return with our first payment. It was explained to us at that time to fill out paperwork ( basically financial statements, earnings, etc…) and first payment as well. Once all the paperwork was complete and submitted as well as the beginning of negotiation, the second payment would be expected. On April 27th, 2010, everything was filled out, completed and faxed back to them. Processing, however took longer than expected since it was requested several times, each time copies sent to us to sign off on had clearly incorrect information ( basic information we sent such as monthly income was several thousand dollars off each time, and at one point in time a person by the name of Kiko claiming to be the underwriter had to retake ALL of the information from scratch, only to have it done incorrectly again ). The process of sending new forms for us to sign and having them redone due to error took months. I would like to add at this point that every time we get a name of a representative, when we call back days later, they surprisingly no longer work there. ( Jennifer , our first contact person fell ill and Jennifer Dixon took her place. Jennifer Dixon in turn no longer worked there some 2 to 3 weeks later, replaced by Cindy, who got us connected with the underwriter Kiko. Several weeks later, there was absolutely no trace of anyone named Kiko. This would continue. ) After receiving more threatening letters from the mortgage company for lack of payment on both monthly payments and house insurance as well as another quarterly tax missed, we called Janian and Associates for an update, since it had been at least 2 weeks since we had last heard from them. I was told at that point that the second payment was due before negotiations with the bank could proceed. This was different information that I was verbalized, so I asked if a partial payment could be sent, and perhaps copies of the paperwork that was to be submitted could be sent to us to show the progress. At this point in time, we had stopped getting paperwork and/or contact from their office and I wanted to see that is was indeed being worked upon. After guaranteeing negotiations have indeed started ( again different that was just stated earlier ) they wanted partial payment. I agreed to send $ 500 once I received copies of the paperwork that was to be submitted to overview and make sure none of the previous errors were listed. That paper was never received by us. Several weeks later I again called and was told by a representative of Janian by the name of Cindy that complete payment was expected, and since it did not, my paperwork was on hold and that until full payment was received, negotiations with the bank could not even be started ( yet again, contradicting information ). At this point, it was decided by both my wife and I that this was getting way out of hand and perhaps we made an error with this company. We called and left a message with the company of our displeasure and needed to discuss with someone either what direction to go to from this point, if anyone from the company can explain to us what exactly was going on with our status, or to please refund our money before the situation got completely out of hand. This is when contact completely diminished. Phone calls from home, work and my cell phone went directly to voicemail. Fax statements were send but not responded to. E-mails were not responded to. After months and months of failed contact, a person named Tisha Williams happened to pick up one of my random calls. After explained to her the issues we had, Tisha told us that payment was due so the account is on hold ( Frighteningly almost word for word the way it was previously explained to us months before by Erika ). I further explained to Tisha that as per our original agreement, that I was cancelling our work in progress with Janian and Associates, considering it a complete failure and wanted a full refund as promised so I could continue my efforts to not lose my house. Tisha took my number and promised to look into the procedure to refund us the money we paid and would let us know how and when to expect that to take place. We called back about a week later to the direct extension she gave us, and although the voicemail still addressed itself as a Janian and Associates line, the name was not Tisha Williams. Apparently, Tisha fell victim to the infamous “ No longer works here “ department, only 1 week later. We have never heard from her, or anyone from Janian again. We have left countless messages, faxes and e-mails to the various names we have been in contact with, ( 2 different people named Jennifer, Erika, Cindy, Nancy, Carolina, Tisha, Kiko, etc )…only to have absolutely no return calls from anyone. `We do not with anything from Janian and Associates other than our initial payment of $ 1250 returned to us as promised. We are at our wits end in trying to have our payment returned to us, so we can sever all ties with Janian and Associates and try to go on with our lives.
