Primecast in Chapter 11 Bankruptcy and Terminating Services May 10th Officially!
I have been a Primecast / Connexion Technologies Customer well over 2 years now and while the tech guys and upper management are usually a pleasure to deal with their customer service and "Tier 1" tech support is not. The company has always had outages, slowdowns, etc since I have been with them. As of today, May 5th, 2012, we received a legal notice regarding their chapter 11 bankruptcy. It not just for our community but for ALL PRIMECAST CUSTOMERS. Services will most likely terminate on May 10th, 2012 for the remaining Primecast customers if the motion is granted. You can view it at http://goprimecast.com/notice, lookup case number: 12-11362 (KG) on GOOGLE, or pasted here; LEGAL NOTICE - - MOTION TO REJECT CONTRACTS IN BANKRUPTCY - - NOTICE OF TERMINATION OF PRIMECAST AND BEYOND COMMUNICATIONS SERVICES On April 26, 2012, the above-captioned debtors and debtors-in-possession (the “Debtors”) each filed a Bankruptcy petition in the United States Bankruptcy Court for the District of Delaware (the “Bankruptcy Court”). You may know the Debtors as “Beyond Communications” or “Primecast.” On May 4, 2012, the Debtors filed a Motion to Reject certain Service and Customer Contracts (the “Motion”) in the Bankruptcy Court. By the Motion, the Debtors are asking for permission from the Bankruptcy Court to stop performing under certain contracts. If the Motion is granted, Beyond Communications and Primecast will no longer offer service to you effective May 10, 2012. You should immediately make arrangements for replacement TELEPHONE AND INTERNET service.YOU ARE RECEIVING THIS NOTICE BECAUSE YOUR CONTRACT WITH PRIMECAST OR BEYOND COMMUNICATIONS, IF ANY, WILL BE REJECTED UNDER THE MOTION, AND THE MOTION AFFECTS YOUR LEGAL RIGHTS. If you wish to object to the Motion, you must: (i) file an Objection with the Clerk of the Bankruptcy Court, 824 Market Street, 3rd Floor, Wilmington, Delaware 19801, on or before May 9, 2012 at 12:00 p.m. (ET) (the “Objection Deadline”); and (ii) serve your Objection so that it is actually received on or before the Objection Deadline by counsel to the Debtors: James C. Carignan, Esq., Pepper Hamilton LLP, Hercules Plaza, Suite 5100, 1313 Market Street, P.O. Box 1709, Wilmington, DE 19801, E-mail: carignanj@pepperlaw.com. A HEARING TO CONSIDER THE MOTION WILL BE HELD ON MAY 10, 2012 AT 1:00 P.M. (ET) AT THE BANKRUPTCY COURT, 824 MARKET STREET, 6TH FLOOR, WILMINGTON, DE 19801. The Motion is available on the Debtors’ website: www.goprimecast.com/notice (the “Website”).
